GUINOT PRUNERA, S.L. (hereinafter, GRAMAR) aims to respect the privacy of its users and to protect the personal data they may provide to GRAMAR.
In compliance with Spanish Organic Act 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights (hereinafter, LOPDGDD) and the European Union General Data Protection Regulation (hereinafter, GDPR), this data collection is governed by the terms set out below:
Information on the data controller, collection, purpose, legal basis and retention period of personal data
This privacy policy contains all the information on the processing of personal data that GRAMAR carries out on users' data. As a sign of its commitment to data protection regulations, GRAMAR permanently makes the information relating to our privacy policy available to users on this website.

Depending on how the user uses this website, GRAMAR will need to process personal data which, in general, will be as follows:
- Identification data (for example, first name, surname, language, contact details, etc.).
- Connection, location and browsing data (for example, if you interact with us from a mobile device).
- Commercial information (for example, if the user subscribes to our newsletter).
GRAMAR reminds users that some of the personal data requested to grant access to any of the functionalities or services of this website will be mandatory, since they are essential in order to provide the service, grant access to the functionality in question, or handle the reason for your enquiry and process it administratively.
Depending on how the user interacts with this website, personal data will be processed for the following purposes:

If the user contacts GRAMAR in exercise of rights protected by a legal provision, including claims or queries relating to GRAMAR's services or products, the legal basis governing that processing is compliance with legal obligations. Where the data provided by the user are the contact details of sole traders and self-employed professionals, the legal basis for the processing is legitimate interest, as provided for in article 19 of Spanish Organic Act 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, in relation to article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. |

The legal basis for processing personal data for the purposes described under marketing is the user's consent. Where a prior contractual relationship exists with the user, provided that GRAMAR lawfully obtained the recipient's contact details and used them to send commercial communications about its own company's products or services that are similar to those initially contracted by the customer, the legal basis for the processing will be legitimate interest, with particular reference to the second paragraph of article 21 of Spanish Act 34/2002, of 11 July, on information society services and electronic commerce. Where the data provided by the user are the contact details of sole traders and self-employed professionals, the legal basis for the processing is legitimate interest, as provided for in article 19 of Spanish Organic Act 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, in relation to article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. |
| Quality surveys | GRAMAR has a legitimate interest in carrying out quality surveys among users in order to analyse user satisfaction with this website, the quality of customer service or the products and/or services contracted. |
| Property valuations | The main legal basis is the user's consent, given expressly by completing and submitting the form provided on the website to request the valuation. In addition, the processing may be based on the application of pre-contractual measures at the data subject's request, since it is a preliminary step towards potentially contracting GRAMAR's real estate services. |
The retention period for personal data will depend on the purposes for which it was collected:

Thereafter, it will be kept until the user withdraws consent or exercises their right to erasure. After that, GRAMAR will keep the data duly blocked for as long as legal liabilities arising from the processing may arise. |
Users are informed that GRAMAR will keep personal data duly blocked for as long as civil, commercial, administrative, criminal or tax liabilities may arise, in compliance with the regulations in force at any given time and until such liabilities lapse. Once these periods have elapsed, the personal data will be deleted.
Data recipients
In order to provide the service and comply with our obligations, we may need to share your personal data with other parties. This data processing will take place as follows:
Access by Data Processors: we allow access to your data to suppliers acting as our Data Processors, under our instructions and with a contract guaranteeing security. The categories of these suppliers are:
- Technology and hosting service providers.
- Customer service providers.
- Marketing and advertising service partners.
- Providers of services relating to GRAMAR's administration.
Disclosure of data to other Data Controllers: we will disclose your data to other entities that will process it for their own purposes only where strictly necessary:
- By legal obligation: to Public Administrations, Courts or Tribunals where a law requires us to do so.
- With your explicit consent: to any other entity, provided you have given us your prior consent.
International transfers
In order to provide the service, the Company may contract the services of technology providers (data processors) located in countries outside the European Economic Area (EEA).
In such cases, GRAMAR will ensure that these transfers are made under one of the appropriate safeguards provided for in the GDPR, such as the signing of Standard Contractual Clauses (SCCs) approved by the European Commission, guaranteeing a level of protection equivalent to the European one.
Users may request further information about these safeguards through the contact channels provided.
User rights
Users who have provided personal data for GRAMAR to process have the following rights:

In such cases, GRAMAR will stop processing the data, except on compelling legitimate grounds or for the establishment or defence of legal claims. |
| Automated individual decision-making | Users have the right not to be subject to decisions based solely on automated processing, including profiling, which produce legal effects concerning them or similarly significantly affect them, always taking into account the requirements set out in applicable law. |
| Right to lodge a complaint | Users have the right to lodge a complaint with the Spanish Data Protection Agency if they believe that the rights set out above in this privacy policy have been infringed, or that the processing of personal data concerning them breaches Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Spanish Organic Act 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights. |
Users, or their legal or voluntary representatives, proving their identity and the relevant power of representation, may exercise the rights described above by sending a written communication to the email address lopd@guinotprunera.com.
Data Protection Officer
GRAMAR has appointed a Data Protection Officer through whom users may raise complaints, claims and suggestions in relation to the processing of their personal data.
Users are likewise informed that they may exercise their rights before the Data Protection Officer via the email address lopd@guinotprunera.com, following the instructions set out in the previous section.
Social networks
GRAMAR is present on the main social networks: Facebook, Instagram, X and YouTube. It therefore acts as Data Controller for the data posted on its profiles arising from friends, likes, followers, comments, pins, etc.
Users expressly accept being subject to the privacy conditions and terms of the various social networks or platforms on which GRAMAR is present, authorising GRAMAR to use the means those networks allow in order to inform users about the different activities and services it carries out.
Minors
Children under 14 may not use the services available on this website without the prior authorisation of their parents, guardians or legal representatives, who shall be solely responsible for all acts carried out through this website by the minors in their care, including completing forms with those minors' personal data and, where applicable, ticking the accompanying boxes.
In this regard, and to the extent that GRAMAR is unable to check whether users are minors, it is for parents, guardians or legal representatives to put in place the mechanisms needed to prevent minors from accessing this website and/or providing personal data without their supervision, with GRAMAR accepting no liability in this respect.
Security applied to personal data
In order to guarantee the security and integrity of the personal data provided, GRAMAR has adopted the technical and organisational measures necessary to prevent the loss of data, as well as unauthorised processing or access by third parties, as required by applicable law and taking into account the state of the art and the nature of the data stored.
Changes to the privacy policy
This Privacy Policy may be updated at any time based on the website's own needs and future legislative changes on privacy, with GRAMAR exclusively reserving this right.
Should such a change be made, GRAMAR will inform users of the changes in question if they are significant for their privacy, so that the changes introduced can be reviewed in order to assess whether to object to the processing of personal data or to unsubscribe from a service or functionality. In any event, if consent is required to process personal data for purposes other than those set out in this privacy policy, the user's consent will be sought in accordance with the data protection regulations in force at any given time.
